EB-2 NIW vs. PERM vs. EB-1A

Three employment-based paths, three very different requirements. Here's how they line up side by side.

    Quick Answer

What's the difference between EB-2 NIW, PERM, and EB-1A?

PERM is employer-sponsored: your employer tests the labor market and files a labor certification before the I-140. EB-2 NIW skips both — you self-petition and ask USCIS to waive the job offer and labor certification because your work is in the national interest. EB-1A is a self-petition too, but it requires extraordinary ability: sustained national or international acclaim evidenced against USCIS's criteria, with no labor certification needed and typically faster visa availability.

    PERM

    Employer sponsor + labor certification

    EB-2 NIW

    Self-petition, waiver of job offer

    EB-1A

    Self-petition, extraordinary ability

    All three

    Filed on Form I-140

    Who files the petition

This is the first practical difference and it often decides the path for people.

    • PERM/EB-2 or EB-3 with labor certification: the employer sponsors and files; leaving that job can disrupt the case
    • EB-2 NIW: you file for yourself, no employer needed and no job offer required
    • EB-1A: you file for yourself as well

    What you have to prove

Each path tests something different, and the evidence sets barely overlap.

    • PERM: that no able, willing, qualified U.S. worker is available for the offered position at the prevailing wage, plus that you meet the job requirements
    • EB-2 NIW: the three Dhanasar prongs — substantial merit and national importance, well positioned to advance the endeavor, and that waiving the requirements benefits the U.S.
    • EB-1A: sustained acclaim, generally by meeting at least three of USCIS's ten regulatory criteria and then passing a final merits determination

    Timing

Timing has two separate layers: how long the petition itself takes, and how long until a visa number is available for your category and country of birth.

    • PERM adds a recruitment and certification stage before the I-140 is even filed, which typically adds many months
    • EB-2 NIW and EB-1A skip that stage entirely — you file the I-140 as soon as your packet is ready
    • Premium processing (Form I-907, $2,965 as of March 1, 2026) carries a 45-business-day window on I-140 petitions
    • Green card availability depends on the monthly Visa Bulletin; EB-1 is generally more current than EB-2, and demand from India and China affects both

    Flexibility after approval

Self-petitions are not tied to an employer, which is why many researchers, founders, and consultants prefer the NIW even when an employer would sponsor them. An employer-sponsored PERM case is tied to a specific position, though portability rules can apply later in the process — a legal question worth asking an attorney about.

Can you pursue more than one?

Yes — filing multiple I-140 petitions in different categories is permitted, and some people pursue an EB-1A and an EB-2 NIW simultaneously or keep an employer's PERM case running alongside a self-petition. Whether that makes sense for you is a strategy question for an immigration attorney.

What Clear Path can help with

We prepare documents; we do not choose your category, assess eligibility, or write petition letters. If you or your attorney have decided on an NIW filing, we complete Form I-140 and I-907, assemble and index the exhibit packet, format recommendation letters, flag translation needs, and provide filing instructions. We are not a law firm and do not provide legal advice.
