Frequently Asked Questions
Do I need to file a brief with every motion in Michigan?
No. MCR 2.119(A)(2) only requires a brief when the motion presents a legal question — for example a motion for summary disposition, motion to compel, or motion in limine. Routine scheduling or procedural motions can be filed without a brief.
How much notice do I have to give the other side before a motion hearing?
Under MCR 2.119(C), you must serve the motion at least 9 days before the hearing if served in person or by mail, or 14 days before if a brief accompanies the motion. E-filed motions served via MiFILE follow the same timing.
Can I file a motion in Michigan without paying the $20 fee?
Yes, if you already have an approved fee waiver (MC 20 — Affidavit of Indigency) on file in the case, most motion fees are waived. If you haven't filed one, we can prepare the MC 20 along with your motion packet.
