Frequently Asked Questions
Does a Michigan will avoid probate?
No. A will directs probate — it tells the probate court how to distribute your assets. If you want to skip probate entirely, you need beneficiary designations, joint ownership, a Lady Bird deed for real estate, or a revocable living trust holding your assets.
Can I write my own will in Michigan without witnesses?
Michigan recognizes holographic (handwritten) wills under MCL 700.2502(2) if the material portions and signature are in the testator's handwriting — no witnesses needed. But holographic wills fail probate more often over formatting issues; a witnessed self-proved will is much safer.
What happens if I die without a will in Michigan?
You die 'intestate' and MCL 700.2101–2114 controls distribution. Spouse and children inherit under a fixed formula that may not match your wishes — for example, if you're married with children from a prior relationship, your spouse only receives the first $150,000 plus half of the remainder.
