    Quick Answer

What is Michigan form MC 12?

Form MC 12 lets a judgment creditor garnish payments that repeat over time — most often wages, but also rent or commissions. A periodic writ in Michigan stays active for 182 days from the date it is issued.

    Who files it

A creditor who already holds an unsatisfied Michigan money judgment.

    Where it goes

The court that entered the judgment; the issued writ is then served on the garnishee, such as the employer.

    Filing fee

$15 statutory writ fee to the court, plus a $35 garnishee processing fee paid to the employer or bank.

What you need before you start

    • The case number and date of the judgment
    • The current balance, including post-judgment interest and costs
    • The debtor's full legal name and, where required, Social Security number
    • The exact legal name and service address of the employer or other garnishee
    • A filed disclosure period start date

How to complete and file form MC 12

    1. 1

Calculate the current balance owed including accrued interest and allowable costs.

    2. 2

Complete the request naming the garnishee exactly as it is legally registered.

    3. 3

File with the court and pay the writ fee so the clerk issues the writ.

    4. 4

Serve the issued writ on the garnishee along with the $35 fee, and serve a copy on the debtor.

    5. 5

Wait for the garnishee's disclosure, which is due within 14 days of service.

Mistakes that get MC 12 rejected

    • Using the periodic form for a bank account, which requires the non-periodic form MC 13 instead
    • Naming a store or brand name instead of the employer's registered legal entity
    • Omitting the $35 garnishee fee, which lets the garnishee ignore the writ
    • Letting the 182-day period lapse without filing a new writ
