    Quick Answer

What is Form I-864 and who has to sign it?

Form I-864, Affidavit of Support Under Section 213A of the INA, is a legally enforceable contract in which a sponsor promises to financially support an intending immigrant. It is required in most family-based immigrant cases. The sponsoring petitioner must generally show household income of at least 125 percent of the Federal Poverty Guidelines for their household size (100 percent for certain active-duty military sponsors), and may add a household member on Form I-864A or bring in a joint sponsor if the income falls short. Clear Path Document Services prepares the form and financial packet; we are not attorneys, CPAs, or tax advisors.

    What we do not do

    • Your income is below the guideline and you are not sure how to use assets or a joint sponsor
    • You are self-employed, recently changed jobs, or have complicated or foreign income
    • You have unfiled tax years
    • You want to understand how long the support obligation lasts and who can enforce it
    • A prior affidavit of support you signed is being enforced against you
