Michigan Response to Summons and Complaint

A Michigan summons starts the clock. Ignoring it almost guarantees a default judgment for the amount claimed. Here is how to protect yourself.

    The Response Deadline

MCR 2.108(A) requires an Answer within 21 days of in-state personal service or 28 days if served by mail or outside Michigan. District court cases follow MCR 2.108(A)(2)-(4) with the same windows.

    What Goes in the Answer

Address every numbered paragraph of the complaint. Admit, deny, or state you lack information. Anything you fail to answer is deemed admitted.

    • Caption matching the complaint
    • Paragraph-by-paragraph responses
    • Affirmative defenses (statute of limitations, payment, release, etc.)
    • Signature and certification
    • Proof of Service (MC 302)

    Filing Fees

District court answer fees are typically $45. Circuit court answer fees run $150+. If you cannot afford the fee, file MC 20 (fee waiver) with income documentation.

    After You File

The case moves to discovery and scheduling. Watch for a scheduling order, mediation notice, or pretrial conference notice. Missing those deadlines can also result in default.
